Pool Rules
ALL PERSONS USING THE POOL DO SO AT THEIR OWN RISK.
These rules are in addition to the North Carolina rules posted in the pool facility.
Board Members and Management Staff have authority to enforce all rules and retains the right to remove individuals who are, in his/her discretion, not following the pool rules, are exhibiting poor behavior, or are creating an unsafe condition for themselves and/or other pool patrons.
RESIDENT ACCESS: (FOB Usage)
- All owners are required to utilize their assigned FOB to access the pool facility. Owners shall not open the pool gate for pool patrons who do not have a working FOB.
- Owners with Delinquent Accounts will be called for a hearing to have pool access suspended until the account becomes current.
GUESTS:
- The pool facility is for the use and enjoyment of Heritage at Neel Ranch homeowners and their guests only.
- Each homeowner is permitted to bring up to FOUR (4) guests at a time. ALL guests must be accompanied,
at all times, by the Homeowner who invited them.
- It is the responsibility of each Heritage at Neel Ranch homeowner to ensure their guests are following all pool rules. Owners shall be personally liable for the actions of their guests, including replacement of damaged property.
GENERAL:
- This is a swim at your own risk pool. Neither the Heritage at Neel Ranch Homeowners Association, nor its assigned agents, assume responsibility for damages, accidents, injuries, or any loss of/damage to person property.
- This pool is managed by Aquatech Pool Management. If a pool maintenance emergency occurs, please call 704-577-5737. Reports should also be made to the Management Staff at 888-600-5044. After business hours or on weekends, please leave a message by choosing option 1.
- Owners shall be expected to leave the pool and bathroom space in the same condition they found it.
- Noise levels shall be kept to a minimum and all pool patrons are asked to show consideration for their fellow neighbors whose homes are located near the pool facility.
- The pool opens and closes yearly at the Board’s discretion.
- The pool may be closed periodically for short periods of time for cleaning or chemical adjustment.
- The pool facility may not be reserved for private parties.
- Bicycles, skateboards, roller blades, “Heelys” and other similar recreational equipment are NOT permitted in the pool area.
HEALTH, SAFETY AND CLEANLINESS:
- All swimmers must shower before entering the pool.
- NO SMOKING is permitted in the pool area. This includes electronic cigarettes (E-cigarettes) and vaping devices.
- ALL GLASS is strictly prohibited in pool area. If glass is broken inside the pool area, the pool will need to be drained and cleaned before reopening and the owner responsible for the glass breakage will be liable for the costs associated with required cleaning and repairs.
- Food and drinks may be consumed in the pool area as long as glass containers are not being used. However, no eating or drinking is permitted in the pool.
- Intoxicated behavior of any kind will not be tolerated. Persons exhibiting intoxicated behavior will be asked to leave the premises and are subject to suspension of pool privileges.
- Littering, including disposal of cigarette butts is prohibited. Deposit all trash in the provided receptacles.
- Proper swim attire is required. No cutoffs or shorts are permitted. Anyone who is incontinent MUST wear sealed swim diapers or place plastic/rubber pants designed for swimming over their diapers.
- DO NOT use the pool while infected with an infectious disease. Persons with excessive sunburns, open sores, bandages, inflamed eyes, colds, nasal or ear discharge or any other ailments which could adversely affect water cleanliness and/or endanger the health of others are NOT allowed to use the pool.
- NO PETS, except licensed guide dogs, are permitted in the pool area.
- NO running, pushing, wrestling, or other horseplay is permitted that could be unsafe or interfere with other patron’s ability to enjoy the pool facilities.
- NO DIVING.
- The use of rafts, baby floats, water balls, and personal clear ring style floats are allowed provided they do not interfere with other patron’s ability to enjoy the pool facility.
- Any non-swimmer using a flotation device, such as but not limited to water wings or floating vests, must be accompanied and supervised by a competent swimmer at all times. The supervising swimmer shall not be more than an arm’s length from the non-swimmer.
- Pool furniture shall not be removed from the pool deck or placed into the pool.
- No audibly loud or distasteful music can be played at the pool or in the pool parking lot.
- The pool will be closed at the discretion of the Board, Management Staff, or Pool Committee in the event of severe weather. The pool area must be evacuated during electrical storms.
ILLNESS AND DISEASE:
- Residents or their guests that are feeling ill shall not enter the pool area until symptoms subside and/or a doctor’s recommended quarantine has ended.
- By using the pool facility, residents and guests acknowledge that there is an inherent risk of exposure to viruses, bacterial infections, or other illnesses in any public place where people are present. Some of these illnesses can lead to severe illness or death, especially to those with underlying health conditions or in vulnerable age groups. By using the facility, residents and their guests acknowledge that the Heritage at Neel Ranch Homeowners Association, Inc., it’s agents, and/or affiliates are not responsible for policing or monitoring social distancing or the health of individuals within the facility aside from staff and that using the facility during times of illness or pandemic are done solely at the resident or guests own risk.
- The Board of Directors, Pool Management Company, or HOA Management Company may close the pool facility at anytime due to increased risk of infection for the safety of the residents and to reduce the liability of the Association.
